Terms of Use, Paid Access Terms, and Wildlife Risk Acknowledgment

Please read these Terms carefully. By visiting the website, creating an account, purchasing access, downloading content, submitting information, or otherwise using the Service, you agree to these Terms. If you do not agree, do not access or use the Service.

1. Acceptance of These Terms

These Terms form a binding agreement between you and Where The Wild Beasts Roam LLC.

These Terms also incorporate the following policies by reference:

Product-specific information shown at checkout controls the price, access period, and listed inclusions for that purchase. These Terms control all other matters unless a more specific written agreement expressly states otherwise.

2. Definitions

“Company,” “we,” “us,” or “our”
Where The Wild Beasts Roam LLC.
“Service”
WhereTheWildBeastsRoam.com and the wildlife map, accounts, routes, filters, field notes, directions, digital guides, previews, downloads, emails, forms, and related features we operate.
“Content”
Text, photographs, video, graphics, map information, routes, field notes, observations, location information, software, data, downloads, branding, and other materials made available through the Service.
“Company Content”
Content owned, licensed, created, selected, or published by the Company, excluding User Content.
“User Content”
Information or materials you submit through the Service, by email, through a form, or through an account. This may include wildlife observations, descriptions, dates, locations, photographs, videos, comments, notes, and other materials.
“Field Information”
Wildlife observations, map entries, photographs, routes, field notes, habitat information, timing information, general viewing areas, and related planning context.
“Paid Access”
Access to features or Content that requires a completed purchase.
“Lifetime Access”
Ongoing account access to the purchased core digital map product for the commercial life of that product, subject to these Terms. Lifetime Access does not mean the purchaser’s natural lifetime. It does not guarantee that every feature, vendor, map layer, URL, geographic region, file format, or technical platform will remain unchanged forever.
“Future Map Improvements”
Corrections, refinements, updates, and features that we choose to add to the core wildlife-map product. This does not automatically include separate products, new geographic regions, guided services, personalized services, premium add-ons, artificial-intelligence products, or products marketed as separately priced.
“Official Sources”
The National Park Service, park rangers, government agencies, emergency authorities, posted signs, official alerts, and other authoritative sources responsible for current rules and conditions.
“Third-Party Services”
Services operated by parties other than the Company, including map providers, navigation services, payment processors, hosting providers, analytics providers, email services, and external websites.

3. Who We Are

4. Eligibility

You must be at least 13 years old to use the Service.

If you are under 18, you may use the Service only with the permission and supervision of a parent or legal guardian. A purchase must be made by someone who is legally able to enter into the transaction or by that person’s authorized parent or guardian.

By using the Service, you represent that you meet these requirements and are legally permitted to agree to these Terms.

5. Purpose and Limits of the Service

The Service is an independent wildlife-planning and educational resource. It is designed to help visitors consider parks, suggested routes, habitat, wildlife species, field context, and possible starting points before or during a self-directed trip.

The Service does not provide:

  • live wildlife tracking
  • a current-sighting feed
  • a wildlife-sighting guarantee
  • turn-by-turn navigation
  • a guided tour or professional guide
  • transportation
  • safety supervision
  • medical, legal, or emergency advice
  • current road, weather, closure, or hazard information
  • a substitute for official park information

You are responsible for checking Official Sources and using an appropriate navigation service before and during every trip.

6. Important Wildlife Safety Notice

Wildlife is unpredictable and can cause serious injury, death, or property damage. An animal that appears calm may react without warning.

You are solely responsible for your safety, decisions, location, conduct, and actions in the field.

You must:

  • follow all current laws, park rules, closures, signs, and ranger instructions
  • keep at least the minimum distance required by the applicable park and increase that distance whenever conditions require it
  • remain at least 100 yards from bears and wolves and at least 25 yards from other wildlife unless a stricter current rule applies
  • carry appropriate safety equipment, including bear spray where recommended, and know how to use it
  • use legal pullouts and pull completely out of traffic before stopping
  • respect private property, restricted areas, seasonal closures, nesting areas, dens, and sensitive habitat
  • back away immediately if an animal notices you, reacts to you, changes direction, stops feeding, becomes agitated, or otherwise changes its behavior because of your presence

You must never:

  • approach, touch, chase, surround, or harass wildlife
  • feed or attempt to attract wildlife
  • use food, calls, sound, bait, lights, drones, or other methods to alter wildlife behavior unlawfully or unsafely
  • block wildlife movement
  • walk between animals or separate adults from young
  • block a roadway or create an unsafe roadside situation
  • encourage other people to crowd or pressure wildlife

Current posted rules, closures, ranger instructions, and official guidance control over anything displayed in the Service.

In an emergency, move to a safe location and call 911 or the appropriate local emergency authority. Do not use the Service as an emergency tool.

7. Field Information, Delays, and No Real-Time Tracking

Field Information may be delayed, incomplete, historical, estimated, generalized, obscured, inaccurate, or no longer representative of current conditions.

Wildlife observations are not published in real time. We do not promise a specific publication schedule. A submission or observation may be delayed for any length of time, generalized, withheld, or never published.

Words such as “recent,” “latest,” “activity,” or “field observation” describe information collected or added to the Service. They do not mean that an animal is currently present at a location.

Map pins and location labels may represent:

  • a broad habitat or viewing area
  • a generalized location
  • a historical observation
  • a suggested place from which to scan a wider area
  • a route-planning reference rather than a precise animal location

Photographs may be historical, illustrative, or connected to an earlier field observation. They are not proof that the photographed animal remains in that area.

Sample and preview Content is for demonstration only. It must not be treated as current field information.

Wildlife moves freely. Weather, season, food sources, traffic, road conditions, human pressure, time of day, and chance can all change what you experience. We do not guarantee that you will see any animal, species, behavior, or wildlife activity.

8. Sensitive Wildlife and Location Protection

We may protect wildlife and visitors by:

  • delaying observations
  • generalizing or obscuring coordinates
  • removing timestamps
  • describing a broader habitat instead of an exact location
  • restricting an entry to certain users
  • withholding information entirely
  • editing, rejecting, or removing User Content

These protections may apply to nesting sites, dens, breeding areas, young wildlife, feeding areas, resting areas, migration corridors, sensitive habitats, private property, or locations vulnerable to crowding.

We are not required to explain why a location was delayed, generalized, restricted, or removed.

9. National Park and Government Affiliation Disclaimer

Where The Wild Beasts Roam is an independent business.

The Company and Service are not affiliated with, endorsed by, sponsored by, operated by, or official partners of:

  • the National Park Service
  • Yellowstone National Park
  • Grand Teton National Park
  • any federal, state, local, tribal, or foreign government agency

References to parks, roads, landmarks, wildlife, and surrounding areas are used only for geographic, educational, descriptive, and informational purposes.

10. Assumption of Outdoor and Travel Risk

Outdoor travel and wildlife viewing involve inherent and unpredictable risks, including:

  • wildlife encounters and attacks
  • injury or death
  • traffic and roadside hazards
  • vehicle breakdowns
  • closed, damaged, or inaccessible roads
  • weather, fire, smoke, flooding, snow, ice, and falling trees
  • rough terrain and changing trail conditions
  • limited or unavailable cell service
  • limited access to emergency services
  • remote locations
  • other visitors and unsafe visitor behavior
  • incorrect, incomplete, or outdated information

By using the Service, you knowingly and voluntarily assume the risks associated with your travel, driving, hiking, wildlife viewing, photography, and other outdoor activities.

You are responsible for deciding whether a location, route, road, pullout, trail, or activity is appropriate for you, your vehicle, your travel party, and current conditions.

11. Accounts and Account Security

Some parts of the Service require an account.

You agree to:

  • provide accurate and current account information
  • keep your login credentials confidential
  • use a secure password
  • notify us promptly of suspected unauthorized access
  • accept responsibility for activity conducted through your account

Unless a checkout page states otherwise, Paid Access is personal to the purchaser. You may not sell, publicly share, commercially distribute, or provide your account to unrelated third parties.

We may require you to reset a password, verify account ownership, or provide reasonable information needed to prevent fraud or restore access.

We are not responsible for losses caused by your failure to protect your login credentials.

12. Paid Access, Pricing, and Billing

Certain Content and features require Paid Access.

Before completing a purchase, the applicable product page or checkout page will state:

  • the price
  • the access plan
  • the access period, if limited
  • the features or downloads expressly included
  • whether the charge is one-time or recurring

The information presented at checkout for your completed transaction controls those product-specific details.

Unless a product is clearly identified as recurring before purchase, the purchase is a one-time payment and will not automatically renew.

We will not convert a one-time purchase into a recurring subscription without your express consent.

We may offer limited-duration access, Lifetime Access, or other plans. Prices, plan availability, and features may change for future purchases.

A price change will not create an additional charge for a completed one-time purchase unless you later choose to buy another product or service.

Lifetime Access

Lifetime Access provides ongoing access to the purchased core map product for the commercial life of that product, subject to:

  • these Terms
  • account-security requirements
  • changes required by law
  • reasonable technical changes
  • the Company continuing to operate and offer the applicable product

We may replace vendors, software, hosting, map providers, account systems, URLs, or technical platforms while continuing to provide the core product in a materially similar form.

Lifetime Access does not require us to preserve every feature, map layer, observation, route, geographic area, integration, download, or third-party service forever.

If we permanently discontinue a purchased product, we will provide any notice or remedy required by applicable law.

Future Map Improvements

Future Map Improvements may be included with Lifetime Access when we choose to release them as part of the core map product.

We may separately develop or sell:

  • new geographic regions
  • standalone applications
  • premium data or tools
  • artificial-intelligence features
  • personalized planning services
  • guided experiences
  • new digital guides or courses
  • other separate products or services

Such separate products are not automatically included unless we expressly state that they are.

Payment Processing

Payments may be processed by a third-party payment processor. That processor may collect and process payment information under its own terms and privacy policy.

We do not store complete payment-card numbers on our own servers.

You are responsible for applicable taxes, bank fees, currency-conversion charges, or other charges associated with your purchase.

Account access generally opens after successful checkout, but may be delayed for payment review, fraud prevention, technical processing, or account verification.

13. 30-Day Planning Guarantee and Refund Policy

Eligible Paid Access purchases include a 30-day planning guarantee unless the checkout page expressly states otherwise.

The 30-day period begins on the purchase date.

If the map does not help you plan with more confidence, you may request a refund within 30 days by emailing:

support@wherethewildbeastsroam.com

Include:

  • the email address used for the purchase
  • the name on the account, if different
  • a brief description of the request

An approved refund will ordinarily be returned to the original payment method. Processing time may depend on the payment processor and financial institution.

The guarantee covers the usefulness of the Service as a planning tool. It does not guarantee:

  • that you will see wildlife
  • that a specific animal will be present
  • that a road, area, trail, or entrance will be open
  • that weather or field conditions will match your plan
  • that the Service will replace navigation or official park information

We may deny a refund request that is:

  • submitted after the 30-day period
  • fraudulent or materially misleading
  • duplicative of an earlier refund
  • part of a pattern of abusive refund activity
  • connected to a violation of these Terms

A completed refund ends the refunded Paid Access and any associated license to paid downloads.

Except for this guarantee and rights that cannot legally be waived, fees are non-refundable.

14. Digital Guides and Downloadable Materials

A purchase may include digital guides, PDFs, checklists, photographs, or other downloadable materials.

Unless we expressly state otherwise, downloads are licensed to the purchaser for personal, non-commercial use only.

You may not:

  • resell or redistribute a download
  • post it publicly
  • share it through a file-sharing service
  • remove copyright or ownership notices
  • use it as part of a competing commercial product
  • claim it as your own work

Purchasing a download does not transfer ownership of the underlying copyright or other intellectual-property rights.

15. User Content

This section applies whenever you submit User Content, whether through an account, submission form, email, map feature, or another part of the Service.

Your Responsibility

You are solely responsible for your User Content.

By submitting User Content, you represent that:

  • you created it or have permission to submit it
  • it is accurate to the best of your knowledge
  • it does not infringe copyright, privacy, publicity, trademark, or other rights
  • it does not contain unlawful, threatening, defamatory, or deceptive material
  • it does not reveal another person’s private information without permission
  • it does not encourage trespass or illegal conduct
  • it does not encourage unsafe wildlife viewing, pursuit, crowding, or harassment
  • it does not expose a sensitive wildlife location in a way that could reasonably increase harm or disturbance

Ownership and License

You retain any ownership rights you have in your User Content.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, format, edit, generalize, obscure, publish, display, distribute, and otherwise use that User Content as reasonably needed to:

  • operate and improve the Service
  • display approved public submissions
  • protect wildlife and sensitive locations
  • moderate submissions
  • promote the Service using Content you submitted for public display
  • maintain backups and records
  • comply with legal obligations

For User Content identified as private, we will use it only as reasonably needed to operate, secure, moderate, or improve the Service, respond to you, or comply with law, subject to the Privacy Policy.

You are not entitled to compensation for User Content unless we agree otherwise in writing.

You may request deletion of User Content, but copies may remain in backups, legal records, security records, or materials created before the deletion request where retention is permitted by law.

16. Submission Review and Moderation

User Content may be held for review and may not appear publicly unless approved.

We may, but are not obligated to:

  • review a submission
  • contact the submitter
  • verify details
  • edit formatting or wording
  • generalize or obscure a location
  • delay publication
  • restrict visibility
  • reject or remove the submission

We may take these actions to protect wildlife, reduce crowding, avoid trespass, address safety concerns, comply with law, enforce these Terms, or maintain the quality of the Service.

Approval or publication does not mean that we verified the accuracy, safety, legality, date, location, or currentness of the submission.

We do not guarantee review times, publication, continued availability, or a response to every submission.

17. Prohibited Uses

You may not use the Service to:

  • approach, pursue, surround, bait, feed, or harass wildlife
  • create or contribute to unsafe wildlife jams
  • locate wildlife for hunting, poaching, capture, trafficking, or other unlawful activity
  • operate the Service as a live wildlife tracker
  • publish sensitive locations in a way that risks harm or disturbance
  • encourage trespass or violation of a closure
  • violate laws, regulations, park rules, signs, or ranger instructions
  • submit false, deceptive, or manipulated field information
  • impersonate another person or misrepresent your affiliation
  • threaten, harass, or abuse another person
  • publish private or confidential information without authorization
  • upload malware, malicious code, or harmful files
  • interfere with the security, availability, or operation of the Service
  • bypass a login, paywall, access restriction, or security control
  • share, sell, rent, or transfer Paid Access unlawfully
  • resell or commercially exploit Company Content without written permission
  • operate a paid tour, guiding service, or competing product using Company Content without written permission
  • scrape, crawl, harvest, download, index, or systematically extract data without written permission
  • use bots, scripts, automated tools, or artificial agents to access the Service except ordinary public search-engine indexing
  • reverse engineer, decompile, or attempt to discover source code except where such a restriction is prohibited by law
  • copy Company Content into another database, map, directory, guide, application, or commercial resource
  • use Company Content to train, fine-tune, test, evaluate, ground, or supply retrieval data to an artificial-intelligence or machine-learning system without written permission
  • help another person engage in a prohibited use

We may investigate suspected violations and cooperate with lawful requests from authorities.

18. Intellectual Property and Limited License

The Service and Company Content are owned by the Company or its licensors and are protected by copyright, trademark, trade-dress, database, contract, and other applicable laws.

This includes, without limitation:

  • the Where The Wild Beasts Roam name and branding
  • Greek Mountain Man materials used with permission
  • site design and interface elements
  • software and map configuration
  • field notes and written descriptions
  • suggested routes and route descriptions
  • photographs, videos, and graphics
  • map entries and selected data organization
  • digital guides and downloads

Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable, non-sublicensable license to access and use the Service for your own personal, non-commercial wildlife planning.

No ownership rights are transferred to you.

Except as permitted by law or approved by us in writing, you may not copy, reproduce, republish, distribute, modify, translate, sell, license, scrape, or create derivative works from Company Content.

You may submit feedback or suggestions. By doing so, you permit us to use that feedback without restriction or compensation, provided we do not identify you publicly without permission.

19. Third-Party Maps, Directions, Payments, and Links

The Service may rely on or link to Third-Party Services, including map tiles, geocoding, directions, navigation, hosting, payment processing, analytics, email delivery, and external websites.

Third-Party Services are governed by their own terms, policies, licenses, availability, and technical limits.

We do not control and are not responsible for:

  • third-party outages or errors
  • incorrect directions or estimated travel times
  • third-party data accuracy
  • route legality, road access, closures, or conditions
  • third-party privacy or security practices
  • content on external websites
  • changes made by a third-party provider

A directions link does not mean that a route is safe, legal, open, maintained, passable, or appropriate for your vehicle.

Check Official Sources and use a reliable navigation service before driving.

20. Connectivity, Offline Use, and Service Availability

The Service may include caching, tile downloads, saved data, or other features intended to help in low-service areas.

We do not guarantee that the entire Service, every map layer, all background tiles, directions, account features, or Third-Party Services will remain available without an internet connection.

Offline availability can depend on:

  • your device
  • your browser
  • available storage
  • previously loaded or downloaded data
  • third-party map-provider rules
  • software updates
  • cache expiration
  • network and device settings

Prepare before entering a low-service area. Keep an independent offline navigation resource, official park information, and emergency information available.

We do not guarantee uninterrupted, secure, or error-free operation. Maintenance, outages, security events, technical changes, and circumstances outside our control may affect availability.

21. Privacy

Our collection, use, retention, and sharing of personal information are described in the Privacy Policy .

By using the Service, you acknowledge that internet transmissions and electronic storage cannot be guaranteed to be completely secure.

22. Copyright Complaints and DMCA Policy

We respect the intellectual-property rights of others.

Copyright-infringement notices and counter-notices must be submitted in accordance with our DMCA Copyright Policy .

We may remove or restrict access to allegedly infringing material and may suspend or terminate repeat infringers where appropriate.

Knowingly submitting a materially false copyright notice or counter-notice may expose the sender to legal liability.

23. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, QUIET ENJOYMENT, AND AVAILABILITY.

We do not warrant that:

  • the Service will always be available, secure, or error-free
  • defects or errors will be corrected
  • Field Information will be accurate, complete, or current
  • a location will be safe, legal, open, or accessible
  • a suggested route will be appropriate for current conditions
  • offline features will work on every device
  • you will see wildlife
  • you will achieve a particular trip, photography, or planning result

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

24. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, CONTRIBUTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

This includes damages or losses arising from:

  • injury or death
  • property or vehicle damage
  • wildlife encounters
  • traffic incidents
  • weather, fire, flooding, snow, or terrain
  • closed, inaccessible, or unsafe roads or areas
  • navigation errors
  • limited service or offline failure
  • reliance on Field Information
  • actions taken before, during, or after using the Service
  • loss of data or User Content
  • service interruption or account loss
  • third-party services
  • lost profits, revenue, business opportunities, or goodwill

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) $100; OR (B) THE AMOUNT YOU PAID TO US DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot legally be limited or excluded. They also do not exclude liability for gross negligence, willful misconduct, or fraud where applicable law prohibits such an exclusion.

25. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, members, employees, contractors, affiliates, contributors, licensors, and service providers from third-party claims, damages, judgments, liabilities, losses, costs, and reasonable legal fees arising from:

  • your User Content
  • your misuse of the Service
  • your violation of these Terms
  • your violation of law, park rules, closures, or regulations
  • your infringement of another person’s rights
  • your unsafe or unlawful field conduct
  • your use of the Service in a commercial activity without permission

We may assume control of the defense of a matter subject to indemnification. You agree to cooperate reasonably with that defense.

26. Suspension and Termination

We may suspend, restrict, or terminate access where we reasonably believe it is necessary because of:

  • a violation of these Terms
  • account sharing or misuse of Paid Access
  • fraud, chargeback abuse, or payment reversal
  • security or technical concerns
  • copyright or intellectual-property violations
  • conduct that may harm wildlife or visitors
  • illegal activity
  • a lawful request or legal requirement
  • discontinuation of the Service

We may act without advance notice when immediate action is reasonably necessary to protect wildlife, users, the Company, or the Service.

If access is terminated because you violated these Terms, you may not be entitled to a refund.

You may stop using the Service at any time. You may request account deletion by contacting support, subject to records we are permitted or required to retain.

Upon termination, your right to use the affected Service and Company Content ends. Provisions that by their nature should survive termination will remain in effect.

27. Changes to the Service

We may add, update, correct, redesign, restrict, replace, or remove parts of the Service.

This may include changes to:

  • map providers and technology
  • routes and field notes
  • map entries and observations
  • filters and account features
  • downloads and integrations
  • available regions
  • submission and moderation features
  • pricing and plans for future purchases

We do not promise that any single feature, observation, route, third-party integration, or Content category will remain available permanently.

A change to the Service will not convert a completed one-time purchase into a recurring charge without your express consent.

28. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.

Before filing a legal claim, you agree to send us written notice describing the dispute and the requested resolution. The parties will have 30 days after receipt of the notice to attempt an informal resolution.

If the dispute is not resolved informally, any legal action must be brought in:

  • a state court of competent jurisdiction located in Teton County, Wyoming; or
  • the United States District Court for the District of Wyoming, when federal jurisdiction exists

Each party consents to the personal jurisdiction and venue of those courts to the extent permitted by law.

Nothing in these Terms prevents either party from seeking appropriate relief in small-claims court or requesting temporary or injunctive relief to protect intellectual property, confidential information, system security, or wildlife safety.

Nothing in this section removes consumer rights or legal protections that cannot be waived under the law applicable to you.

29. Changes to These Terms

We may update these Terms to reflect changes in the Service, our business, legal requirements, safety practices, or technology.

The revised Terms will be posted on this page with an updated “Last Updated” date. When reasonably appropriate, we may also provide notice through the Service or by email.

Material changes will apply prospectively from their stated effective date unless the law requires otherwise.

Continued use of the Service after revised Terms become effective means you accept the revised Terms.

A revision will not retroactively convert a one-time purchase into a subscription or shorten a stated limited-access period without your consent, except where required by law or where access is terminated under these Terms.

30. Miscellaneous

Entire Agreement

These Terms, the incorporated policies, and the product-specific information shown at checkout form the entire agreement between you and the Company concerning the Service.

Severability

If a court finds any provision invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

No Waiver

A failure to enforce a provision is not a waiver of that provision or any other right.

Assignment
